Landmark Ruling on Area Plans
Landmark judgements were delivered on 7th September on the Judicial Reviews on draft Northern Area Plan and draft Magherafelt Area Plan.
Following the judgements into the two draft Area Plans detailed above we are led to believe that there could be implications for other draft Area Plans including draft Banbridge & Newry and Mourne Area Plan.
In the meantime there are remedy hearings to be held in November to attempt to resolve the position and potentially put in place interim measures in relation to Planning Policy in both the Northern and Magherafelt areas.
In the meaintime we understand that the Planning Service will not be making any decisions on applications where there are implications from the Area Plans.
